Modelo 720 in Spain

Modelo 720 is Spain's electronic information return for specified assets and rights located abroad. It is not a tax-payment form, but the reporting rules are technical: three asset groups, ownership roles, exemptions, valuation dates and later-year filing triggers must be analysed separately.

Three independent reporting obligations

One electronic form contains three legally separate information blocks. A threshold or exemption must be tested for each block rather than against the total foreign wealth.

Who may have to file

The rules can affect Spanish tax residents who are owners, beneficial owners, representatives, authorised signatories, beneficiaries or holders of specified rights. Companies and other entities can also be within scope, although accounting-based and other exemptions may apply.

Joint ownership does not automatically remove the obligation: the full asset value and the person's participation or role may need to be disclosed.

Thresholds and repeat filings

The initial obligation is commonly tested using the statutory threshold for each of the three blocks. Once a block has been reported, it is not necessarily filed every year: later reporting can arise when the aggregate value increases by more than the prescribed amount, an asset is transferred or a reported status ends.

The precise balance or valuation date differs by asset type. Foreign-currency amounts must be converted under the applicable official criteria.

What is not reported on Modelo 720

Foreign virtual currencies are not reported in Modelo 720; Spain uses a separate information regime and form for qualifying cryptocurrency holdings abroad. Assets already covered by a valid exemption should not be inserted merely for caution without checking the consequences.

Deadlines, corrections and evidence

Modelo 720 is filed electronically for the relevant calendar year within the official filing period. Before submission, retain account statements, year-end and average balances, acquisition values, ownership percentages, policy details and exchange-rate support.

Late or incorrect filings require individual advice. A correction should identify whether data must be amended, added or removed and should be coordinated with the taxpayer's IRPF, wealth-tax and source-of-funds records.

Does Modelo 720 itself calculate tax?

Must it be filed every year?

Not necessarily. After an initial filing, later-year triggers such as prescribed value increases, transfers or the end of a reported status must be checked.

Are cryptocurrencies included?

No. The Tax Agency states that foreign virtual currencies are not reported on Modelo 720; a separate regime may apply.
