Gifts and Donations in Spain
A lifetime gift involving Spain can create gift tax for the recipient, capital-gains tax for the donor and municipal plusvalía for urban property. Regional reliefs and formal requirements must be checked before transferring money or signing a deed.
Who is taxed on a gift?
The recipient generally pays Spanish gift tax where residence or Spanish-situs assets bring the transaction within Spanish scope.
The donor can separately realise a taxable capital gain even though no sale price is received.
Regional rules and formal requirements
Autonomous communities set important reductions and rebates based on relationship, residence, asset and formal conditions.
Some reliefs require a public deed, stated purpose, source-of-funds evidence or maintenance of the gifted asset.
Documents and evidence
Identity, kinship, residence, bank trail, valuations, title and prior gifts support Modelo 651 and the deed.
Identity and kinship certificates
Tax-residence evidence
Bank and source-of-funds records
Property deed and valuation
Draft gift deed and prior gift information
Property, money and international gifts
Spanish property gifts require a notarial deed, tax filing and Land Registry inscription and can trigger municipal plusvalía.
Cross-border bank gifts need evidence of donor ownership, transfer purpose and foreign reporting or tax consequences.
Deadlines, risks and individual strategy
Gifting mortgaged, low-basis or appreciated property without modelling donor tax can cost more than an eventual inheritance.
Jurisdiction, personal circumstances and current administrative or court practice must be checked for every case. We prepare the Spanish file and coordinate the appropriate regulated specialist where representation is required.
Useful official resources
Official requirements, fees and procedures can change. The competent authority and current rules are checked for each individual case.
