Who must pay Spanish inheritance tax?

Spain may tax an inheritance when the beneficiary is Spanish tax resident or when inherited assets or rights are located in Spain. Non-resident heirs can therefore have a Spanish filing obligation for Spanish property, accounts, investments or other assets.

The taxpayer is normally each individual beneficiary, not the undivided estate. The calculation must reflect what that beneficiary receives and their personal circumstances.

State rules or autonomous-community rules

Competence and the available reductions, multipliers, credits and rebates depend on residence and the location of assets. The result can differ materially between autonomous communities.

Current Spanish rules also allow qualifying non-resident cases to apply relevant autonomous-community legislation. The correct connection must be established rather than assuming that only state rules apply.

Tax base, valuations and deductible amounts

The starting point is the beneficiary's share of the net estate. Real estate, accounts, securities, business interests, vehicles, insurance and household contents require the legally appropriate values.

Qualifying debts, charges and expenses may be deductible if properly evidenced. Prior gifts and life-insurance proceeds can affect the filing and should be reviewed together with the estate.

Modelo 650 and the six-month deadline

Modelo 650 is generally used for inheritance-tax self-assessment. The ordinary filing and payment period is six months from the date of death.

An extension for an equivalent period may generally be requested once, but the request must be made within the first five months. Interest and the exact regional procedure must be considered. Waiting for all estate documents without protecting the deadline can create surcharges or penalties.

Filing before registration and release of assets

Banks, notaries and registries commonly request evidence that inheritance tax has been filed before releasing or transferring assets. A tax filing does not by itself complete the inheritance; the notarial, registry and banking steps remain separate.

Where funds are unavailable, payment, instalment or deferral options should be assessed early. Municipal plusvalía can also arise on inherited urban property and has its own procedure.
