Deutsch Registering a Trademark in Spain
A company name, domain or social-media handle does not automatically protect a brand. Trademark protection requires the right filing strategy, precise goods and services and monitoring of objections or oppositions. We coordinate Spanish OEPM and EU trademark applications.
Spanish trademark or EU trademark?
An OEPM registration covers Spain. An EUIPO registration can cover all EU member states through a single right but may face objections or earlier rights anywhere in the EU.
Territory, expansion plans, budget and conflict risk should guide the filing route.
Clearance before filing
A search should go beyond identical names. Similar spelling, sound, meaning, logos and related goods or services can create opposition or infringement risk.
Company and domain checks remain useful but are not substitutes for trademark databases.
Goods and services
Protection is organised through the Nice Classification. The specification should cover genuine commercial plans without using vague, excessive or incorrect wording.
After filing, the list cannot simply be expanded; new coverage may require another application.
Examination, publication and opposition
The office examines formal and absolute grounds and publishes the application. Owners of earlier rights may oppose within the prescribed period.
Responses can involve legal argument, limitation of goods, coexistence negotiation or proof of use of an earlier mark.
After registration
Trademarks require renewal, monitoring and genuine use. Ownership changes, licences and security interests should be documented and, where appropriate, recorded.
Online marketplace complaints and customs action may also rely on a properly maintained registration.

Not necessarily. Company-name and trademark rights serve different purposes.
How long does protection last?

Can I add products later?
The filed specification cannot simply be broadened after filing; a new application may be needed.
Is a search compulsory?
Not always, but filing without clearance can waste fees and expose the business to opposition or infringement risk.
