Occasional freelance work in Spain: can you invoice without registering as autónomo?

Updated: 23 October 2026. A translation, a repair or a website for a client: before accepting a one-off assignment in Spain, separate two questions. What does the tax authority require? And must you register for self-employed social security? Answering one does not automatically answer the other.

1. Tax registration and RETA are different

If the assignment is an economic activity, tax census registration is generally required before starting, even for a planned single job. The AEAT explains the registration deadline. Use Modelo 036: Modelo 037 was abolished from 3 February 2025. Filing 036 does not settle whether RETA registration is required.

Article 305 of the General Social Security Law refers, among other conditions, to habitual, personal, direct, independent and profit-seeking activity. Continuity, organisation and how the service is actually offered therefore matter. The number of invoices alone does not determine the outcome.

2. Earnings below the minimum wage are not a general exemption

Income below Spain’s minimum wage, the SMI, does not automatically rule out habitual activity. It is one indication to assess alongside the nature of the work. See the BOE-published analysis of judgment ECLI:ES:TS:2025:3484.

For illustration, a single translation without advertising or plans to continue raises different questions from a translation service advertised continuously and taking weekly assignments. Neither example decides an individual case without further facts. Nor is “one invoice a month without autónomo registration” a universal safe harbour.

3. A specific exception for certain retirement pensions

Social Security describes a specific retirement-pension compatibility rule: self-employed work with annual income no higher than the annual SMI may be carried out without contributions under the statutory conditions. That work creates no new benefit entitlement. This is not an allowance available to everyone with small freelance earnings.

Check your exact pension, which income counts and any notification required before starting. Foreign pensions, other benefits and supplements need their own assessment. Do not transfer a retirement-pension rule to employment income, unemployment benefits or any other payment.

4. A fee is not always business income

Article 17 of the Income Tax Law treats certain lectures, courses and literary, artistic or scientific works with exploitation rights assigned as employment income. Organising your own resources or staff to supply services can instead make this an economic activity. This tax classification does not automatically settle VAT or social security.

5. Invoices, income tax and VAT

A full invoice needs, among other details, consecutive numbering, dates, identification of the parties, a service description and tax details where applicable. Read the AEAT’s invoice requirements. Labelling a payment “occasional collaboration” or “one-off work” does not replace those details.

For professional activities, an exception to quarterly income-tax advance payments requires at least 70% of the previous year’s income to have been subject to withholding; on starting, the relevant period is used. See AEAT guidance on advance payments. This is not an exemption from income tax itself.

Spanish VAT, IVA, applies in mainland Spain and the Balearics; the Canaries have IGIC. A separate Modelo 400 registration with the Canary Islands tax authority may also be needed. The customer’s location, service and exemptions determine the actual treatment: do not add tax by habit or omit it just because the assignment is isolated.

A checklist before the first assignment

  1. Describe the service, duration, client and any plans for repeat work or advertising.
  2. Set out your current position: employment, pension, benefits and country of residence.
  3. Ask for tax registration and social-security status to be assessed separately.
  4. Clarify the fee, taxes and paperwork before preparing the invoice.
  5. Keep the assessment, supporting records and a calendar of remaining obligations.
